website. By using our website and/or Services, you hereby agree to have read and
acknowledged this Terms of Service and the Privacy Policy set forth herein (collectively referred to as “Agreement”), without modification.
The Privacy Policy (“Privacy Policy”) contained herein outlines how we may collect, use, and
share information about you when using our website, together with products and services we
offer from time to time on our website and social media pages, including, but not limited to,
Instagram, YouTube, LinkedIn, Facebook and Pinterest (collectively referred to as “Services”). This Policy describes both our and your legal rights and responsibilities with regards to information contained on and collected by our website, including information that identifies you, such as your name, location, contact information, e-mail address, search tendencies, and how you use our website (collectively referred to as “Personal Information”). We take seriously our responsibility to protect your personal information and privacy.

(collectively referred to as “using” or “visiting”) our website. By using our website, the user
accepts to be bound by the terms included herein and shall remain effective so long as
the user avails itself of the website’s Services.

posted on our website and will be effective when published unless otherwise stated. If you use our website or Services after the effective date of any changes, then you agree to comply with the changes and the entire Agreement.
Ananya Madhavan may revise these terms of use for its website at any time without notice. By using the Site, you are agreeing to be bound by these Terms and Conditions of Use.

To use or access our website and Services, you must be eighteen years or older than the age of majority, and must have the ability to enter into this Agreement.

You hereby agree to use our website, content, products, and other Services for legitimate and non-commercial purposes only. You understand that Ananya Madhavan makes no guarantees regarding any results based on any action or inaction relating to your life, social media accounts, or businesses based on the information we share or services we sell or share for free through the Site. Ultimately, we will not be responsible or make any promises for what will happen in your life and business. Even if you’ve worked with us as a client before and had specific results, we make no guarantee that they will happen again. We cannot be any more clear about this: We are here for you and want you to succeed, but we do not make promises regarding results.

We make no guarantee of any kind regarding the potential income or other results that can be generated through the use of our Services, products or website. From time to time, we may publish testimonials from clients - however, please keep in mind that past results are not an indication or promise of your results.
D. Affiliate Programs
We reserve the right to link to products or services for which we earn a commission, affiliate fee,or referral fee (all of which are interchangeable and mean the same thing for purposes of this Agreement). We will take reasonable measures to ensure that all affiliate links are labeled and disclaimed conspicuously.
E. Limitation of Liability
To the fullest extent permitted by applicable laws, we disclaim liability for any injuries, losses, or damages of whatever nature arising from the following, either directly, indirectly or consequentially: loss of use, loss of data, damage by Virus, loss or damage to property, claims of third-parties. In no event shall Ananya Madhavan or its affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to view or use the materials or content on the Site, even if Ananya Madhavan has been notified orally or in writing of the possibility of such damage.
To the maximum extent permitted by applicable law, neither we, its licensors, suppliers, partners, affiliates or third-party service providers shall be liable to you or any third party for any direct, indirect, incidental, special, exemplary, punitive or consequential damages, or any other form of damages in any manner arising out of or in connection with this Agreement or your use of the Services or any Content, regardless of the form of action or the basis of the claim or whether or not we have been advised of the possibility of such damages.
F. Testimonials
We love to share our students’ wins and successes from inside our programs. By signing up for the Program, you grant Ananya Madhavan permission to use any testimonials in our marketing materials and/or any promotional efforts. This includes but is not limited to unofficial testimonials, words of praise via Instagram stories, public posts or posts inside our Facebook groups, and direct messages with Ananya Madhavan. We will blur full names on screenshots used, and you understand that all confidentiality provisions apply and that testimonials are the only exception to our confidentiality obligations.
Section 6. SECURITY & INDEMNIFICATION
In order to maintain the security of your Personal Information, we have taken reasonable
methods to prevent unauthorised access and maintain accuracy of all Personal Information
collected by our website. Physical and technical methods of protection include limited numbers of internal personnel accessing your Personal Information, and password protecting documents or logs that contain Personal Information.
Transmission of information over the internet is not fully secure. As such, we cannot guarantee that any information you submit to us will be accessible to only us as the intended recipients.
Any transmission is at your own risk. However, we do our best to protect your data and any
information you provide. Nevertheless, if there is a security breach on behalf of an unauthorized party, you agree to indemnify us and hold us harmless for any and all claims against the unauthorised party.
We strive to prevent the introduction of malware, malicious code, and viruses to our website and our users (collectively referred to as “viruses”). However, due to the inherent nature of the internet, we are unable to guarantee or warrant that our websites, products, content or other Services are completely free from viruses. As such, we will not be liable for any damages or harm that is attributable to viruses that may arise after use of our website or Services. We may, in our discretion, participate in the defense of any such claim or action and any negotiations for its settlement or compromise. No settlement which may adversely affect our rights or obligations shall be made without our prior written approval. We reserve the right, at our own expense and on notice to you, to assume exclusive defense and control of any such claim or action and then your corresponding indemnification obligation will end.

This Privacy Policy does not cover the collection and/or use of your personal information by
third-party programs or websites, such as search engines (i.e. Google), commerce platforms
and plugins (i.e. Wix, PayPal, RazorPay, Dubsado), educational websites & communication platforms (i.e., Zoom, WhatsApp, Teachable etc.), website hosts (i.e wix.com) or social media platforms. The collection and use of data and information by third-party platforms and programs, such as those described above, are governed by each third-party’s respective privacy policy. However, you should not assume that third-parties have a privacy policy that is equivalent or similar to ours. As such, we are not liable or responsible under any circumstances for the collection and use of your personal information by third-parties or the third-parties’ compliance with their respective privacy policies.
By accepting our Privacy Policy, you hereby acknowledge that you are above the age of consent and majority in your jurisdiction. Minors should not use this platform and, as such, we do not knowingly or intentionally collect, share, or use Personal Information from minors.

Information in exchange for products or services - From time to time, we ask for personal information, such as names, e-mail addresses, phone numbers, and billing addresses in an exchange for our product, content, or Services.
Analytics - This website collects data, such as visitor location and times, in order to help us analyse user data and better serve our users. From time to time, our website may collect data such as cookies, pixel tags, clickstreams, and other modern technology to collect information such as browser type, web pages viewed, links clicked, and other actions you may take either on our website or via social media accounts and e-mails associated with us. This information may be used from time to time to help us personalise your experience or for security purposes. B. E-mail Marketing - We may, from time to time, require your e-mail address and other
Personal Information to use our Services. If you do not want us to contact you via e-mail for
promotional purposes, account management, updates, or product information, then you can
elect not to share your e-mail address with us (although it may nevertheless be necessary to
utilise a certain Service). At any time, you may manage your e-mail subscription preferences by

Section 11. GOVERNING LAW
This Agreement is governed by the laws of India, without regard to its conflicts of law provisions; and you hereby consent to the exclusive jurisdiction of courts in New delhi, India with respect to all disputes arising out of or relating to the Services. In addition, you hereby consent to the exclusive jurisdiction of and venue in such courts for any action commenced by you against us (or our affiliates).
Ananya Madhavan, Ananya Madhavan Coaching, Ananya Madhavan Consulting is located in New Delhi, India and is subject to the applicable laws governing the National Capital Region, India. The governing law for this agreement is the laws of India.
Section 12. INTELLECTUAL PROPERTY & STOCK PHOTOGRAPHY
A. Stock Photography - This website may use free stock photography as part of its design.All stock images used have an irrevocable, non-exclusive copyright license to download, copy, distribute, use and modify the photos for free, including for commercial purposes. Use of said stock photography is permissible under applicable laws without permission from the photographer or attributing the work to the photographer.
B. Course Access - Students receive access to our programs, materials and private student community for the duration of the number of months specified in the program upon the time of enrollment. For Example if the student has chosen the 4 month program, then access to materials, documents etc. will be granted for exactly 4 months. Student access activates immediately upon enrolling in the program, and we do not offer account holds. We understand everyone has different learning styles and goes through the program at their own pace, and if for any reason, a student is unable to complete the program within the stipulated access period, the student will have an option to opt-in for our paid course extension.
C. Course Updates + Bonuses - Our team actively updates our programs to ensure the majority of students’ biggest roadblocks are anticipated, minimized, and addressed. Please note, enrolling in our program does not grant free access to any future programs, bonuses, future courses and materials other than the ones promised to be offered upon the time of enrollment.
D. Intellectual Property - Indian copyright laws protect all materials created by Ananya Madhavan on the Site as original works. All materials belong to Ananya Madhavan, including those with the absence of a registered copyright symbol.This website, content and products contain intellectual property owned by us and by third-parties that license some intellectual property to us. This Agreement is intellectual property owned by us. Other examples of intellectual property found on our website and within our products and Services include, but are not limited to: trademarks, service marks, layout, logos, business name, design, text, written content & copy, certain images, podcast recordings, videos, audio files, and all of our paid products (collectively referred to as “Intellectual Property”). You shall not copy, publish, transmit, transfer, sell, create derivative works from, reproduce, or in any way exploit any of the Intellectual Property owned by us and the third-parties described within this Section in either whole or part without prior written consent.
All right, title and interest in the Services including the Content in and to the Services are and will remain the exclusive property of Ananya Madhavan and/or third parties (as applicable). The Services including the Content are protected by copyright, trademark and other laws of Republic of India. We reserve all rights including those not expressly written in this Agreement. Content available through the Services may be viewed and used for your personal, non-commercial use only. Except as expressly provided herein, you are not granted any rights or license to patents, copyrights, trade secrets or trademarks with respect to the Services or the Content, and we reserve all rights not expressly granted hereunder. We do not permit copyright infringing activities and infringement of intellectual property rights on or through the Services, including the Content. We request that you will promptly notify us in writing upon your discovery of any unauthorized use or infringement of the Services (including the Content) or our patent, copyright, trade secret, trademarks or other intellectual property rights. You agree that you will not, and you will not encourage, assist or authorize any other person to, directly or indirectly, for any reason whatsoever, reverse engineer, decompile, disassemble, or otherwise tamper with any security components, usage rules or other protection measures applicable to the Services or the Content. You further agree that you will not, and will not enable others to, except as expressly permitted hereunder, (i) copy, reproduce, decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code of or underlying ideas or algorithms of any part of the Services (including without limitation any application), (ii) modify, translate, or otherwise create derivative works of any part of the Services, (iii) retransmit, distribute, disseminate, sell, perform, make available to third parties, or exploit for any purposes (including, without limitation, personal, non-commercial use) the Services or the Content, or any part thereof, without express prior written consent from us (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by licensing terms governing use of open-sourced components included with the Services). You further agree not to make use of the Content in a manner that would infringe the copyright therein. Any attempt to do so is a violation of our rights. You agree to abide by the rules and policies established from time to time by us. You also acknowledge and agree that any feedback, comments or suggestions you may provide regarding the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation or compensation to you.
C. Intellectual Property Ownership - We will grant a revocable, non-exclusive license for you to download copies of the downloadable materials from this Site for personal, non-commercial transitory viewing only.
Under this license, you may not:
A. Modify or copy the materials;
B. Use the materials for any commercial purpose, or any public display (commercial or non-commercial);
C. Share course materials or login credentials to access the program
D. Transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Ananya Madhavan at any time. Upon the termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
Suppose Ananya Madhavan discovers that you have illegally misappropriated or used any intellectual property you were granted access to. In that case, you will be added to our block list for any future programs by Ananya Madhavan, and you will be required to cover all legal fees necessary to enforce these rights.
We may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation ownership provisions, warranty disclaimers, indemnity and limitations of liability.
D. Reporting Intellectual Property Infringement - If you believe that your copyright work has been copied and posted in the Services in a way that constitutes copyright infringement, please provide us with the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) your contact information, including your address, telephone number, and an email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner, by sending email to theananyamadhavan@gmail.com. We will take appropriate action as mandated under applicable laws, including the Information Technology Act, 2000 (including the Rules framed thereunder). We will remove the Content upon receipt of an infringement claim if we believe in good faith that it is likely that the subject Content is infringing intellectual property right of any third party.
Section 13 PAYMENT TERMS
Blocklist + Disputed Payments. Ananya Madhavan retains the right to ‘Blocklist’ you from accessing all materials, courses, or other products or services she offers in the event that you do not pay your outstanding balance, dispute your payments, or if you steal any of our intellectual property. A student will be removed from the blocklist under the discretion of Ananya Madhavan. Under the conditions that the outstanding balance has been paid in full.
Payment Plans. Ananya Madhavan offers two payment options at the time of purchase, so you can either pay in full or in two equal installments. If you opt for a payment plan, you will be responsible for paying the remaining invoices. By signing up for our payment plan, you agree to pay the entire balance owing of your payment plan. If you wish to pay off your remaining account balance in full, you can do so at any time, but to be eligible for our discounted pay-in-full price, you must email us within 10 days of enrolling. In the event that a payment is not made, Ananya Madhavan will temporarily suspend access until the payment(s) is caught up.
Breaking Payment Plans + Discontinued Payments. In the event that your agreed-upon payment plan is broken, our team will permit a three-month grace period and will actively work with you to get payments back on track. However, after three months of delinquent payments, you will be charged a 10% fee of the monthly payment due for every month of missed payments after that, for up to one year. The 10% late fee will only commence after your initial three-month grace period.
· For example: If you have paid the first three months but then pause your payment plan for the fourth month and fail to get back on track after three months, you will owe 10% for EACH month (up to one year) that your account is inactive. You will have to pay this amount before you can re-access your account.
C.1 To get back on track with our program after 3+ months of delinquent payments, you must make up for ALL past due payments and late fees. Your access will be re-granted once your entire account is paid off.
D Refund Policy - Due to the nature of the products and Services provided, and the electronic transmission of same, you hereby agree and acknowledge that all sales are final. You agree and acknowledge that your purchase of any product or Service is non-refundable, under any circumstances.

The Services may contain Content specifically provided by us, our partners or our users and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Services.
You shall not: (i) take any action that imposes or may impose (as determined by us at our sole discretion) an unreasonable or disproportionately large load on our (or our third party providers) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Services or any activities conducted on the Services; (iii) bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services (or other accounts, computer systems or networks connected to the Services); (iv) run any form of auto-responder or “spam” on the Services; (v) use manual or automated software, devices, or other processes to “crawl” or “spider” any part of the Services; (vi) harvest or scrape any Content from the Services; or (vii) otherwise take any action in violation of our guidelines and policies.
We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce this Agreement, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of us, our users and the public.
You shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any Content on or through the Services that: (i) infringes any intellectual property, proprietary rights or confidentiality obligations of others; (ii) does not belong to you; (iii) you know is false, misleading, untruthful or inaccurate or that could damage us or any third party; (iv) is fraudulent, unlawful or contains or promotes defamatory or illegal information and activities, images, materials or descriptions; (v) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another\’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner, as determined by us in our sole discretion; (vi) causes duress, distress or discomfort to another or is likely to deter or discourage others from using the Services, as determined by us in our sole discretion; (vii) constitutes unauthorized or unsolicited advertising, junk or bulk messages (“spamming”); (viii) harms minors in any way; (ix) contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of ours or of any third party; (x) impersonates any person or entity, including any of our employees or representatives; (xi) includes anyone’s identification documents or sensitive financial information; or (xii) threatens the unity, integrity, defence, security or sovereignty of India or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting to any other nation.

A. Amendments - We reserve the right to amend this Agreement from time to time. You are bound by any changes made after the publication of the changes on our website. We will take reasonable efforts to notify you of any changes that are made.
B. Headings & Severability - Headings are included for convenience purposes only and shall not affect the construction of this Agreement. If any portion of this Agreement is held to be unenforceable, it shall not affect the remaining portions of the Agreement, which shall remain in full effect. If any portion of this Agreement is held to be unenforceable, then the unenforceable portion shall be construed in compliance with applicable law in a light most favourable to the original intentions of the parties. If the unenforceable portion of the Agreement is found by a competent court of this jurisdiction to be contrary to law, then it shall be changed and interpreted to best reflect the original intentions of the parties, and all other provisions shall remain in full force and effect.
C. Entire Agreement - This Agreement reflects the entire agreement between the parties. This Agreement trumps any other existing negotiations, communications or Agreements between the parties, whether written, oral, or electronic, and is the full extent of the Agreement between the parties.
D. All Rights Reserved - All rights not expressly granted in this Agreement are reserved by
us.
